Please read these Terms & Conditions ("Terms") carefully before placing an order. By placing an order with us, you agree to be bound by these Terms.
1. Definitions
- "Company," "We," "Us," "Our" refers to Friendship Memorials.
- "Client," "Customer," "You," "Your" refers to the person or entity placing an order with us.
2. Acceptance of Terms
By ordering products or services from us, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, please do not place an order.
3. Orders & Proofs
3.1 Order Placement
All orders must be made in writing and accompanied by required deposits or full payment as specified at the time of purchase.
3.2 Final Proof Approval
Before production begins, we will provide you with a final proof of the memorial, including text, dates, fonts, and artwork.
By approving the final proof in writing or electronically, you confirm that all details are correct. Once all stone proofs are final, that is what the stone will be, and no changes will be made after approval. You are solely responsible for reviewing and approving the accuracy of the proof.
4. Payments & Deposits
Deposits, installment payments, or balances must be paid as outlined in your order agreement. Ownership of memorials transfers only after full payment is received.
5. Lead Times & Delays
Production and delivery times are estimates and may vary due to weather, stone availability, shipping delays, cemetery permits, or events beyond our control. We are not responsible for delays outside our control.
6. Site Conditions & Installation
You (or the cemetery/third party) must ensure that the installation site is accessible, safe, and meets any cemetery or third-party requirements. We are not responsible for site conditions that interfere with installation or damage not caused by our actions.
7. Warranty & Workmanship
We warrant that materials and workmanship will conform to agreed specifications at the time of installation.
- Minor natural variations in stone color, texture, and engraving are inherent and do not constitute defects.
- We are not responsible for damage caused by third parties, acts of God, vandalism, cemetery maintenance, or ground settling after installation.
8. Limitation of Liability
To the fullest extent permitted by law:
- Our liability for any claim related to your order is limited to the amount paid by you for the specific product or service.- We are not liable for indirect, incidental, special, or consequential damages, including emotional distress, loss of use, or property damage.
9. Cancellation & Changes
Orders may not be canceled after proof approval. Any cancellation before that point may be subject to administrative or design fees to cover labor and material costs.
10. Governing Law
These Terms and any disputes arising from them will be governed by the laws of South Carolina.
11. Changes to Terms
We may modify or update these Terms at any time. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
